These Terms of Use ("Terms") are a legal agreement between you and HaagLabs, the independent developer that operates MaliceTV ("MaliceTV", "we", "us", "our"). They apply to the MaliceTV app on Android TV, phones and tablets, and to the website malicetv.com (together, the "Service"). By selecting "I agree", or by installing or using the Service, you accept these Terms and our Privacy Policy (malicetv.com/privacy.html). If you don't accept them, don't use the Service.
The app shows these Terms the first time it opens, and again only if they change in an important way. You can read them any time in Settings › Terms of Use.
MaliceTV is a neutral media player and hub. It ships empty: it does not include, host, sell, stream, index or link to any movies, shows, channels, playlists or add-ons. Apart from our own original games and music, everything you see or play comes from sources you choose to connect yourself, such as a TV service you subscribe to, your own antenna tuner, your own media files, a third-party add-on or a debrid account.
This includes Live TV: the app has no channels until you add a source.
Buying MaliceTV Pro unlocks app features only. It never includes, or gives access to, any channels, streams or other content.
You alone are responsible for every source, playlist, link, add-on, account and key you add to MaliceTV, and for everything you watch, record or download with it. By using MaliceTV you confirm that:
We don't control, review or endorse anything that comes from a source you add, and we have no relationship with the people or companies who provide it. If a playlist, add-on or service works in MaliceTV, that doesn't mean we approve of it or that it is legal where you live. Names of other companies and services belong to their owners and are used only to describe what MaliceTV can work with.
Some features (trailers on the home screen and title pages, Trailer Shuffle and recipe videos) play videos in YouTube's own embedded player, using YouTube API Services. By using MaliceTV you also agree to be bound by the YouTube Terms of Service: YouTube Terms of Service
Those videos come from YouTube, not from us, and the Google Privacy Policy applies to them: Google Privacy Policy
We never charge for watching anything in the YouTube player.
MaliceTV can show information from services such as TMDB, TheTVDB and TheMealDB, and can connect to services you choose, including third-party add-ons, premium links, cached torrent networks and debrid accounts. These services are run by others, not by us. We don't operate, host, control or monitor their servers or the content they deliver, and we are not responsible or liable for them, for whether they work, or for any content fetched, cached, streamed or downloaded through them. Each service has its own terms, and it's up to you to follow them.
We give you a personal, limited, non-exclusive, non-transferable and revocable license to use MaliceTV on devices you own or control, under these Terms. You may not sell, rent, sublicense or redistribute the app, remove its notices, or copy, modify, decompile or reverse-engineer it, except where the law allows you to.
MaliceTV Pro is an optional one-time purchase that unlocks extra features. A free 7-day Pro trial is included on each device. Pro bought in the app is sold and processed by Google Play under Google Play's terms; a Pro key bought on our website is redeemed in Settings. Refunds follow our Refund Policy (malicetv.com/refund.html) and, for Google Play purchases, Google Play's refund rules. Nothing here limits rights you have under consumer law.
The MaliceTV name and logo, the app, the website, and our original games and music belong to us and are protected by law. You can enjoy them as part of normal use of MaliceTV, but you may not copy, sell or redistribute them.
Kids profiles and the parental PIN are tools to help parents. How well they work depends on how they are set up and on the sources you add, so they can't guarantee that everything shown is suitable. A parent or guardian remains responsible for what a child watches.
MaliceTV doesn't host or store third-party media: what you play comes straight from the sources you connect. We respect copyright and respond to notices of claimed infringement under the U.S. Digital Millennium Copyright Act (DMCA) and similar laws.

If a notice concerns a third-party source, add-on or service, we can't remove content we don't host, so you may also need to contact that provider. In appropriate circumstances, we will end the use of MaliceTV services (such as Pro keys and cloud sync) by people who repeatedly infringe.
MaliceTV is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We don't promise that it will always work, that it will work with every source, device or service, or that it will be free of errors. Some things are outside our control, such as other services changing or shutting down.
To the fullest extent the law allows, MaliceTV and its operators are not liable for any indirect, incidental, special, consequential or punitive damages, for any loss of data, profits or goodwill, or for anything arising from content or services you add or connect. If we are found liable, our total liability is limited to the amount you paid us for MaliceTV in the 12 months before the claim. Nothing in these Terms limits liability that the law doesn't allow to be limited.
To the fullest extent the law allows, you agree to indemnify, defend, and hold harmless MaliceTV and its operators (including HaagLabs and its owner) from and against any claims, demands, losses, damages, liabilities, costs and expenses, including reasonable legal fees, arising out of or related to:
We may choose to take control of the defense of any such claim. If we do, you agree to cooperate with us.
You can stop using MaliceTV at any time by uninstalling it. If you seriously or repeatedly break these Terms, we may end your right to use the app and any related services. Sections 2, 3, 5, 10, 11, 12, 13 and 16 keep applying after that.
We may update these Terms. If a change is important, MaliceTV will show you the new Terms to accept the next time you open it. The current version is always at malicetv.com/terms.html.
These Terms are governed by the laws of the United States and of the state where the operator lives, except where the law of your country gives you protections that can't be taken away. These Terms, together with our Privacy Policy and Refund Policy, are the whole agreement between you and us about the Service. If any part of these Terms can't be enforced, the rest still applies. If we don't enforce a part of these Terms straight away, we haven't given up the right to enforce it later. Translations are for convenience; if they differ, the English version applies.
